RULES REGULATING THE GRANT OF AWARD TO A MARRIED COUPLE IN WHICH EITHER
OF THE PARTIES OR BOTH ARE DISABLED PERSONS
1.TITLE:
These rules shall be called the Goa Grant of Award for marriage with disabled persons, 1994. (Revised scheme 2001). These rules shall be applicable throughout the State of Goa and shall come into force from the date of its publication in the Official Gazette of the Government of Goa.
2.OBJECT:
The objective of this scheme is to encourage normal persons to accept disabled person as a life partner and to assimilate the handicapped persons in the mainstream of society.
3.APPLICABILITY:
These rules shall be applicable to a married couple in which either one or both the married partners are disabled with a minimum of 50 % disability and whose total family income does not exceed Rs.50,000/- per annum.
4.DEFINITIONS:
I. Government:- Government means the Government of Goa.
II. Director:- Director means the Director of Social Welfare, Government of Goa.
III. Disabled Persons:- Disabled persons will include the following categories:
(a) Locomotor Handicapped, (Orthopedically Handicapped). A person having physical defect or deformity which causes hardship in normal functioning of bones muscles and joints.
(b) Leprosy cured persons and spastics.
(c) Visually Handicapped who suffer from either of the following conditions:
(i) Total absence of sight.
(ii) Visual equity not exceeding 6/60 or 20/200 (Snellen) in the better eye with correction lenses i.e. limitation of the field of vision of 20 degree or more.
(d) Hearing Handicapped in whom the sense of hearing is non-functional for ordinary purpose of life and who do not hear, understand sound at all even with amplified speech. The cases included in this category will be those having hearing loss of more than 70 decibel in the better ear (profound impairment) or total loss of hearing in both ears.
(e) Multiple Handicapped who suffer from more than one of the disabilities mentioned under 4 (III) above (only those couples in which at least one on the partners is disabled with a minimum of 50 % disability in the categories mentioned under Rule 4 (III), above shall be eligible to apply for the award).
5.CONDITIONS OF ELIGIBILITY:
(i) The applicant should be a bonafide resident of Goa for the last 15 years and will be eligible for award only if he/she applies within three years from the date of their marriage.
(ii) The marriage should take place in Goa and both the husband and wife should be living together for a period not less than two years.
(iii) At least one of the parties to the marriage should be a handicapped person as defined under Rule 4 (III) above.
(iv) The total family income should not exceed Rs.50, 000/- per annum.
6.RATE AND MODE OF PAYMENT OF AWARD:
(i) The eligible married couple will be granted monetary award for the purpose to the extend to Rs.25,000/- which shall be paid to the partner who is handicapped. (In case, both are handicapped the amount shall be jointly paid in the name of both partners).
(ii) The grant of award will be sanctioned by th Director of Social Welfare and will be drawn and disbursed to the party concerned as mentioned in 6 (i) above, by the Block Development Officer of the respective Block.
7.MODE OF APPLYING:
The application for Grant of award for marriage with disabled person under these Rules shall be made in form as prescribed in Appendix I. The application should be submitted to this Directorate through the respective Block Development Officer. The application shall be signed by both the wife and husband and shall be accompanied by the following documents:
(1) Marriage Certificate: Marriage Certificate issued by the Sub-Registrar of the Registration Department of the Government of Goa showing that the marriage has been registered in his office.
(2) A Medical Certificate in the prescribed form Appendix VI to VIII (as applicable) issued by either the Medical Board at Asilo Hospital, Mapusa or Hospicio Hospital, Margao or by the Head of the concerned Department of the Goa Medical College and Hospital, Bambolim.
(3) A Certificate from the concerned Block Development Officer in Appendix II to the effect that both the husband and wife are living together for not less than two years.
(4) A Declaration in Appendix-III to be jointly signed by both the parties that they will not resort to separation or breakage of marriage except under legal provisions.
8.OTHER TERMS AND CONDITIONS:
(i) The grant of award under these rules cannot be claimed as a matter of right.
(ii) A couple whose family income from all sources does not exceed Rs.50,000/- per annum, is eligible to apply for the grant.
(iii) Bonafide of the applicant will be enquired into by the Block Development Officer and the enquiry report in Appendix II along with
the application shall be forwarded to the Directorate of Social Welfare for consideration.
(iv) If a person who has received the grant of award contracts another marriage involving a handicapped partner after dissolving the first marriage on account of which he/she has availed the grant of the award, then he/she along with his/her partner will not be again eligible for the grant of award, on account of the second marriage, under these rules.
9.GRANT OF AWARD:
(i) The applications received shall be scrutinized by the Directorate of Social Welfare.
(ii) The Director of Social Welfare shall be the sanctioning authority under these rules and his decision as regard to the selection or rejection for the grant of award shall be final and binding.
10.CANCELLATION OF AWARD:
The award shall be cancelled if at any stage the information furnished by the applicant is found to be incorrect or that the award has been obtained by suppressing any material facts. In such a case, the amount of award shall be recovered in full.
11. INTERPRETATION AND RELAXATION:
i. The Director of Social Welfare shall be the final authority concerning the interpretation of these rules.
ii. The Government may relax any of the provision of these rules for good and sufficient reasons.

Amendments to the Rules regulating the Grant of Award for Marriage with Disabled Persons.
1. Short title, commencement and applicability.
1. These Rules shall be called Grant of Award for a Marriage with Disabled Persons (Amendment) Rules,2006.
2. They shall come into force from July 1, 2006.
3. They shall be applicable throughout the State of Goa.
2. Amendment to Rule 4.
In Rule 6(i) of Goa Grant of Award for Marriage with Disabled Persons Rule 1994 (hereinafter refereed to as the “Principal Rule”) for the letters figures and words “Rs.15,000/-” the letters figures and words “Rs.25,000/-“ shall be substituted.
